İslamiyet’in Türkler tarafından kabul edilmesiyle birlikte Türk edebiyatında, İslamiyet’i konu alan eserler telif edilmiştir. Bu eserlerin bilhassa tevhid, naat, münâcât ve hâtime bölümlerinde Allah’ın rahmetine ve Hz. Muhammed’in şefaatine nail olmak arzusunun dile getirilmesi bir gelenek hâline gelmiştir. Zamanla, şefaati konu edinen ve başta Hz. Muhammed olmak üzere Allah’ın şefaat etmesine müsaade buyurduğu kişilerden şefaat isteğinde bulunulan manzum ve mensur müstakil eserler telif edilmiştir. Bu eserler, dinî-tasavvufi türlerden ayrılarak şefaatnâme olarak adlandırılmıştır. Şefaatnâmelerin geneli, eski Anadolu Türkçesi döneminde telif edilen Hikâye-i (...) Kesikbaş, Hikâye-i Deve, Hikâye-i Güvercin, Hikâye-i Geyik, Hikâye-i Kız, Hikâye-i İsa, Hikâye-i İsmail ve Hikâye-i İbrahim gibi dinî manzum hikâyelere anlatım ve üslup özellikleri bakımından benzemektedir. İslam dinini halka öğretmek amacıyla sade bir Türkçe ile kaleme alınan ve tahkiyenin ön planda olduğu bu hikâyelerden biri, muhtevasından dolayı şefaatnâme türü içerisinde değerlendirdiğimiz Şefaatnâme-i Yahyâ’dır. Çalışmamıza konu edilen bu eser, Süleymaniye Kütüphanesi Yazma Bağışlar Bölümü’nde 4042 demirbaş numarasıyla kayıtlı olan ve içerisinde Süleyman Çelebi’nin (ö. 1422?) Vesîletü’n-Necât’ı ile eski Anadolu Türkçesi döneminde telif edilen dinî muhtevalı pek çok manzum hikâyenin bulunduğu yazmanın 155a-160a sayfaları arasında yer almaktadır. Şefaatnâme-i Yahyâ, aruzun “fâ‘ilâtün / fâ‘ilâtün/ fâ‘ilün” kalıbıyla ve mesnevi nazım şeklinde yazılmıştır. 154 beyitten müteşekkil bu eserde, Hz. Muhammed’in günahkâr ümmet için üzülüp ağlaması, o esnada sohbetinde bulunan Hz. Ebû Bekir, Hz. Ömer, Hz. Osman, Hz. Ali, Hz. Ayşe ve Hz. Fatma’ya günahkâr kullara şefaat için ne yapacaklarını sorması ve onların da bu soruyu cevaplamaları tahkiye edilmiştir. Bu makalede, öncelikle şefaatnâme hakkında bilgi verilmiştir. Ardından, Şefaatnâme-i Yahyâ’nın dil, şekil, anlatım ve muhteva özellikleri incelenmiştir. Sonrasında ise Yahyâ’nın Şefaatnâme’sinde ele alınan konunun Ömeroğlu’nun (ö. 14. yy) Şefaatnâme’sinde, Pir Muhammed’in (ö.?) Şefaatnâme’sinde, Topkapı Sarayı Müzesi Kütüphanesi Y. Y. 520/2 numarada kayıtlı yazmanın 30a-34a yaprakları arasında bulunan müellifi meçhul bir şefaatnâmede de yer alması sebebiyle bu dört metin mukayese edilmiştir. Farklı şairlerin kaleminde, aynı olay örgüsünün nasıl ifade edildiği bir tablo dâhilinde ortaya konmaya çalışılmıştır. Makalenin sonunda, Şefaatnâme-i Yahyâ’nın transkripsiyonlu metni hazırlanarak araştırmacıların istifadesine sunulmuştur. (shrink)

Haber-i vâhidin delil değeri problemi, 2. (8.) yüzyıldan itibaren kelamcılar (:Mutezile), fıkıhçılar ve hadisçiler arasında tartışılan ve hakkında kayda değer bir literatür ortaya çıkan usûlî konuların başında gelmektedir. Şeybânî (ö. 189/805), Şâfiî (ö. 204/820), İsâ b. Ebân (ö. 221/836) ve Buhârî (ö. 256/870) gibi sünnî ekolün tanınmış fıkıh ve hadis alimlerinin haber-i vâhid lehine ortaya koydukları çalışmalar bu noktada oldukça etkili olmuştur. Bu etkinin bir sonucu olarak başlangıçta haber-i vâhidi toptancı bir yaklaşımla reddeden Mutezili isimler, yerini zamanla Ebû Ali el-Cübbâî (...) (ö. 303/916) gibi başka bir delille desteklenmesi şartıyla kabul eden alimlere bırakmıştır. Cübbâî, muhtemelen Kitâbü’l-ahbâr isimli günümüze ulaşmayan çalışmasında, hem tek kişinin haberi anlamındaki haber-i vâhidin hücciyet delillerini tenkit etmiş hem de çeşitli delillerle kendi kişisel görüşünü temellendirmeye çalışmıştır. Onun bu tenkit ve görüşleri, 4. (10.) yüzyılın önemli Hanefi fakih ve usulcüsü Cessâs (ö. 370/981) tarafından usul ilminin kurucu metinlerinden el Fusûl’de üstü kapalı bir şekilde nakledilmiş ve eleştirel bir değerlendirmeye tabi tutulmuştur. Araştırmamızda Cübbâî’nin, haber-i vâhidin delil değeri, kabul şartları konusundaki eleştiri ve görüşleri ile Cessâs’ın ona verdiği cevaplar ve karşı eleştirileri ele alınmıştır. (shrink)

ABSTRACTOn 4 September 2015 asylum seekers who got stranded in Budapest’s Keleti train station began a march to cross the Austrian border. Their aim was to reach Germany and Sweden where they believed their asylum claims would be better received. In this article, I argue that the march should be characterized as an act of civil disobedience. This claim may seem to contradict common convictions regarding acts of civil disobedience as well as asylum seekers. The most common justifications are given (...) with reference to moral rights of citizens and concerns for enhancing justice or democracy within states. Asylum seekers are not members of the European public. How can they be entitled to break the law? I first show that the march displays features of a paradigm case of civil disobedience. Then, I identify moral reasons for asylum seekers to carry out the march acceptable from both strong and weak cosmopolitan perspectives. After that, I point out its corrective, stabilizing and democracy-enhancing roles in the European political landscape. I conclude by emphasizing that conceptualizing the march as an act of civil disobedience is significant in recognizing asylum seekers as political agents making claims within an evolving framework of refugee protection. A DO model (here also referred to a Paris model) is a model of set theory all of whose ordinals are first order definable in . Jeffrey Paris (1973) initiated the study of DO models and showed that (1) every consistent extension T of ZF has a DO model, and (2) for complete extensions T, T has a unique DO model up to isomorphism iff T proves V=OD. Here we provide a comprehensive treatment of Paris models. Our results include the (...) following:1. If T is a consistent completion of ZF+V≠OD, then T has continuum-many countable nonisomorphic Paris models.2. Every countable model of ZFC has a Paris generic extension.3. We develop the method of iterated ultrapower representation to provide a unified and perspicuous approach for building automorphisms of countable recursively saturated models of Peano arithmetic . In particular, we use this method to prove Theorem A below, which confirms a long-standing conjecture of James Schmerl.Theorem AIf is a countable recursively saturated model of in which is a strong cut, then for any there is an automorphism j of such that the fixed point set of j is isomorphic to .We (...) also fine-tune a number of classical results. The principal result of this paper answers a long-standing question in the model theory of arithmetic [R. Kossak, J. Schmerl, The Structure of Models of Peano Arithmetic, Oxford University Press, 2006, Question 7] by showing that there exists an uncountable arithmetically closed family of subsets of the set ω of natural numbers such that the expansion of the standard model of Peano arithmetic has no conservative elementary extension, i.e., for any elementary extension of , there is a subset of ω* (...) that is parametrically definable in but whose intersection with ω is not a member of . We also establish other results that highlight the role of countability in the model theory of arithmetic. Inspired by a recent question of Gitman and Hamkins, we furthermore show that the aforementioned family can be arranged to further satisfy the curious property that forcing with the quotient Boolean algebra collapses 1 when viewed as a notion of forcing. A model M = (M, E,...) of Zermelo-Fraenkel set theory ZF is said to be θ-like, where E interprets ∈ and θ is an uncountable cardinal, if |M| = θ but $|\{b \in M: bEa\}| for each a ∈ M. An immediate corollary of the classical theorem of Keisler and Morley on elementary end extensions of models of set theory is that every consistent extension of ZF has an ℵ 1 -like model. Coupled with Chang's two cardinal theorem this implies (...) that if θ is a regular cardinal θ such that $2^{ then every consistent extension of ZF also has a θ + -like model. In particular, in the presence of the continuum hypothesis every consistent extension of ZF has an ℵ 2 -like model. Here we prove: THEOREM A. If θ has the tree property then the following are equivalent for any completion T of ZFC: (i) T has a θ-like model. (ii) $\Phi \subseteq T$ , where Φ is the recursive set of axioms {∃ κ(κ is n-Mahlo and "V κ is a Σ n -elementary submodel of the universe"): n ∈ ω}. With the excessive emphasis that modern PhD training places on the epistemological contribution of the thesis, a question that arises is: do PhD programmes help PhD students achieve philosophia – “love of wisdom”, or do the programmes just facilitate deepening and developing students’ knowledge? This paper challenges the modern approach to PhD training and by extension all academic research, and considers phronesiology, a wisdom-based approach to research design, to add value to traditional epistemic methodologies. In illustration, we use phronesiology and (...) social practice wisdom principles to reflect on the merits of a recently completed empirical study of wise managerial decision-making. Through a reflective analysis, this paper demonstrates that phronesiology not only allows for contributions to knowledge, but can, as a matter of principle and choice, also increase research practitioner wisdom. In doing so, this may enable researchers to implement better and more comprehensive intellectual and practical outcomes that deal effectively with the economic, social, political, and environmental complexities of the contemporary world. Further, we argue that such a wisdom approach is more “practical” than further instrumentalizing PhD training. The paper offers a series of phronetic reflective questions for PhD researchers in social sciences, especially in organizational and management fields, to consider when designing and carrying out research. The struggle for domination clearly persists in The Homecoming as it does in almost all of Pinter’s works. Because of the vague atmosphere, enigmatic characters, and dark, tragicomic dialogue and action, a single decisive meaning for the play cannot be identified. Many character analyses have been carried out on the play, frequently focusing on Ruth and her decision at the end. Moreover, critics have sought to read the play in the light of psychoanalysis, centering on the characters’ past and complexes. (...) By adding a sociopolitical dimension to purely realistic or symbolic readings, this article attempts to analyze the relationships of domination and servitude between characters at the micro-level of the family structure through Marx’s notions of fetishism in relations between individuals, and commodity fetishism as expounded by Slavoj Žižek. With the help of Žižek’s ideas on ideology, a new layer of sociopolitical signification to the relationships held between characters is added, particularly that between Ruth and the men, which is seen as a parallel to the macro-level fetishized relationships in pre-capitalist societies and commodity fetishism in a capitalist one. The presence of the woman priest presiding at the Eucharist causes a `collision' with traditional phallocentric Christian rites, not least around blood sacrifice. Sociological, philosophical and psychological research has found this to be a male-only practice designed to control women. I argue that the woman priest brings new and recovered meanings and possibilities relating to the maternal divine that revivify and enrich old interpretations associated with the Eucharist. A doubly gendered priesthood symbolically connects bloodshed not only with violence and death (...) but with birth and nurturing, with nature and with community. Women's priesthood calls for sexual difference to be acknowledged and celebrated within the Christian narrative in a way that allows both women and men to flourish as children of God. (shrink)

This article first tries to show that there is an affinity between an embarrassing violation of autonomy in a significant example of Persian writing style nearly one thousand years ago, and Foucault’s desire in his inaugural speech in 1970. Then, after it explains arbitrary rule as the real of the Iranian society in contrast with the societies where capitalism is established, it uses the 2013 Iranian presidential election as an instance of how a truly emancipatory political act in the country (...) would involve an even more embarrassing situation, because the act is not anything but full identification with the arbitrary power being administered. Outcomes of interspecific competition, and especially the possibility of coexistence, have been extensively studied in theoretical ecology because of their implications in community assemblages. During the last decades, the influence of different time scales through the local/regional dynamics of animal communities has received an increasing attention. Nevertheless, different time scales involved in interspecific competition can result form other processes than spatial dynamics. Here, we envision and analyze a new theoretical framework that couples a game theory approach for competition with a (...) demographic model. We take advantage of these two time scales to derive a reduced model governing the total densities of the two populations and we study how these two time scales interfere and influence outcomes of species competition. We find that a competition process occurring on a faster time scale than demography yields a “priority effect” where the first species introduced outcompetes the other one. We then confirm previous findings stipulating that species coexistence is favored by large difference in time scales because the extinction/recolonization process. Our results then highlight that an integration of demographic and competition time scales at both local and regional levels is mandatory to explain communities assemblages and should become a research priority. Background Nursing documentation as a pivotal part of nursing care has many implications for patient care in terms of safety and ethics. Objectives To explore factors influencing nursing documentation from nurses’ perspectives in the Iranian nursing context. Methods This qualitative study was carried out using a qualitative content analysis of data collected from 2018 to 2019 in two urban areas of Iran. Semi-structured interviews (n = 15), observations, and reviews of patients’ medical files were used for data collection. Ethical considerations (...) This study was conducted in accordance with the ethical principles of research and regulations in terms of confidentiality of data, anonymity, and provision of informed consent. Findings The main theme of this study was “unsafe documentation.” Two categories, “types of errors in reporting” and “reasons of errors in reporting,” and 12 subcategories were developed indicating factors influencing nursing documentation in the Iranian nursing context. Conclusion In general, individual, organizational, and national factors affected nursing documentation in Iran. In this respect, hiring more nurses, application of reforms in the healthcare management structure, devising appropriate regulations regarding division of labor, constant education of healthcare staff, establishment of clinical governance, improvement of interpersonal relationships, development of hardware and software techniques for documentation, and provision of support should be done to improve the quality of nursing documentation. The above-mentioned suggestions can help nurses with a safe, ethical, lawful, and reliable documentation in nursing practice. (shrink)

This article critically engages with Denis Villeneuve’s Blade Runner 2049, focusing on the relationship between colonial logics and biological engineering that understands the natural world as property. First, it discusses the connections between the film and the shifting status of biopolitics becoming thanatopolitics, prompted by advances in synthetic biology. It argues that the film’s preoccupation with the reproductive capacity of its replicants retraces a racialized colonialism and reconfigured slavery, or the voluntary labour of the occupied – as normalized in synthetic (...) biology and the ongoing processes of devaluing of some lives over others for socioeconomic reasons. Second, and relatedly, the film reveals how deeply the thanatopolitics of a biopolitical economy is rooted in an intensification of racialized and colonial logics. The film thus doubles as a medium in which to grasp the centrality of colonial and racial logics to the ongoing real subsumption of life by capital, and the ways in which it continues to shape the present. Muslims living in England are living in a predicament. On the onehand, they have to face the reality that the laws governing the family institutionare secular in nature. This poses a threat to their identity and freedom ofreligion. On the other hand, they are commanded by Islam to settle theirdisputes according to its laws and principles. However, this is unrealistic,simply due to the fact that the only recognized legal system in England isthe English Law. To circumvent this situation, certain Muslim (...) scholars andcommunities have established quasi-judicial courts, acting in the capacity ofmediators, counsellors, arbitrators and even judges, in order to settle maritaldisputes. These courts, known as Shariah councils, provide a modern approachto alternative dispute resolution, whereby Muslim families and individualscan have their disputes resolved amicably. It was also set up as a response forMuslims to adapt to life under the English secular laws in which they live in,that do not afford them the right of having a Sharʑah-based institution. Onesuch Shariah council offering a modern approach to settling marital disputesamicably is the Islamic Council of Europe. The researcher conducted anin-depth interview with the said council and was able to collect a couple ofarbitrational cases and analysed them in order to give a better understandinginto its inner workings, its structural set-up and operation. Hence, this paperaims to critically and juristically analyse them from an Islamic legal maximperspective while taking the Muslim minority context into consideration. (shrink)

Muslims in the U.S. are increasingly looking to integrate into its society while trying not to lose their identity as Muslims. They find themselves in a dilemma when it comes to the issue of congratulating and even partaking in the festivals of non-Muslims in the U.S. This issue has gained prominence and momentum after the event of 9-11, in which the Muslims wanted to show and prove their tolerance and acceptance towards others while trying to hold onto and maintain the (...) core principles of Islam. For this reason, this topic is a hotly debated issue in the U.S. and the West in general and a cause of division and confusion amongst Muslims. However, in order to justify their position and feel that they are following the teachings of Islam, they turned to the Islamic scholars, both in the West and the Muslim world, regarding the permissibility or prohibition of congratulating and partaking in non-Muslim festivals. This paper employs a qualitative methodology to analyse the fatāwā of permissibility and its effects on the Muslims living as minorities in the U.S. This qualitative method will give readers an insight, through a questionnaire that was conducted by the researchers, into how the Muslims in the U.S. perceive the issue of congratulating and/or partaking in the religious festivals of the non-Muslims. The purpose of this study is to examine the impact of two comparative leadership styles on organizational performance outcomes. The leadership styles undertaken is transformational and servant leadership. A sample of 155 participants is taken from profit-oriented service sector of Pakistan. Data through survey gathered on a five point likert scale from organizations. AMOS and SPSS are used for statistical analysis. The result shows that, transformational leadership has more impact on organizational learning than servant leadership. Furthermore organizational learning enhances organizational (...) performance. Managers and leaders of corporate sector can get benefited from this study. Their main objective is to maximize the profitability of organization thus, they can choose leadership style which polishes their abilities and helps them to achieve profit maximization. (shrink)

The recent development of CRISPR/Cas9 technology has rekindled the ethical debate concerning human germline modification that has begun decades ago. This inexpensive technology shows tremendous promise in disease prevention strategies, while raising complex ethical concerns about safety and efficacy of the technology, human dignity, tampering with God’s creation, and human genetic enhancement. Germline gene editing may result in heritable changes in the human genome, therefore the question of whether it should be allowed requires deep and careful discussion from various perspectives. (...) This paper explores Islamic perspectives on the concerns raised and highlights the ethical principles in Islam that should be taken into consideration when assessing the permissibility of CRISPR/ Cas9-mediated human germline gene editing. As argued in this paper, human germline gene editing would be considered lawful for medical purpose under certain conditions. It should not be applied on humans until the safety and efficacy issues are resolved. Robust ethical guidelines and strict regulations are necessary to preserve human dignity and to prevent premature and misuse of the technology. Maqasid al-shariah’s principles of preservation of human life, lineage, and dignity and ‘preventing harm takes precedence over securing benefit’ are among the guiding principles in assessing the permissibility of CRISPR/Cas9-mediated human germline editing from an Islamic perspective. Further discussions are important to address the controversies as well as to explore the related ethical principles. (shrink)
